Putnam asked about all the times Martinez went to MJ's house over the months after MJ's death. Martinez confirmed he was there several times(ABC7)

Judge Palazuelos asked Martinez if the police had secured MJ's property. Martinez said MJ's house was secured from 2:30 pm PT until about midnight on the day MJ died.

Putnam showed Martinez picture of the front door of MJ's house. The detective identified the entrance as the one he used to enter the property. Martinez said the house has 3 levels: 1st, 2nd, basement w/ movie theater, exercise room, wine cellar; all very clean and organized. (ABC7) Although the foyer of the Holmby Hills home was pristine — a lavish, open space with ornate gold frames — and the dining room boasted flowing white curtains around giant windows that allowed in streaming sunlight, the second floor presented a scene that was radically different (LATimes) Although the entryway was immaculate, the second floor — where Jackson had been found by paramedics earlier that morning — was a deep contrast.(LATimes)

Putnman zeigt Bilder vom Haus. Martinez beschrieb Zustand. Es gab einen radikalen Unterschieder zur 1. und 2. Etage. 1. Etage war strahlend, hell, mit Sonnenlicht durchflutet. 2.

A portable rack was jammed with hangers of clothing. More clothes were strewn about the room, including on the rumpled bedspread. On a desk were stacks of what appeared to be DVDs and papers. Books lay in piles on the floor. Lining the hallway floor that led from the bedroom to the master closet and a bathroom were piles of clothes. Inside the closet was a globe, shopping bags, a dress form with a red coat trimmed in black, and cardboard boxes that overflowed with even more clothes. Papers were strewn about the star’s bathroom, which had another cardboard box stuffed with clothing. Bags and towels lay scattered about. Inside the inlaid marble bathtub were additional towels. Nearby sat fancy glass bottles filled with liquids.(LATimes)

Martinez said the room seemed messy but it didn't seem out of the ordinary. It was night and day compared to the rooms downstairs, he opined(ABC7)

On the 26th, Martinez got a search warrant to search the house since he had obtained more information in the investigation. (ABC7)

Martinez said that when he arrived, Jackson’s children and his brother Randy were at the home. He also saw three cars, including Murray’s BMW. (LATimes)

Martinez said he believes Dr. Murray's first orders of Propofol were in March 2009. They were shipped from Las Vegas to Santa Monica. Putnam asked Martinez about the medical equipments found at MJ's house: oxygen tanks, IV stand, ambu bag. "It was rented by Dr. Murray". No court tomorrow Friday May 3, 2013. Jacksons told the judge toxicologist Mr. Anderson and coroner Dr. Rogers are expected to testify on Monday.(ABC7)

Dr. Murray Dodged Wrongful Death Lawsuit in 2007
Michael Jackson wasn't the first patient to die while in Dr. Murray's care -- in fact, TMZ has learned MJ investigators spoke with the son of a former Murray patient who BLAMES the doc for killing his dad in a botched surgery.

      0104_Conrad_Murray_getty_ex_2
Months after MJ's death, LAPD detectives spoke with Gerard White -- whose father died 6 days after Dr. Murray operated on his heart in Las Vegas back in 2007.

White told investigators Murray not only botched the surgery and ripped a hole in his dad's heart -- but he failed to recognize obvious, tell-tale signs that his patient was fatally wounded.

Gerard told investigators he and his family contacted a lawyer to go after Dr. Murray -- but they couldn't find an attorney who would take the case because there wasn't enough money to be made.

Gerard also said that after his father died, Murray did "exactly what he's doing in the Jackson case" ... because he never attempted to speak with his family members about the situation.

Murray's rep tell TMZ Gerard's story is "hearsay and totally unsubstantiated."

The rep adds, "Murray has medical insurance for lawsuits. If an attorney thought Gerard White had a case he surely could have been paid. The fact that White couldn’t find a lawyer to take the case tells me White's claims most likely had no merit."

MJ Estate’s motion to seal medical record

Estate’s motion to seal medical records is denied and the medical records are ordered to get unsealed.

Judge’s reasons for denying the motion to seal medical records include: court records being presumed public, public’s right of access to information, both Katherine and AEG stating they will be relying on medical records, how Michael’s medical history is the main issue in this trial, parties right to fair trial and how it would be impractical to close down the courtroom to public when medical information is presented.

The same day of this ruling Estate has filed a second amended notice of motion to seal which would be heard August 16, 2013.

Court is also allowing the 14 additional names on Katherine’s witness list.

      3. Late identified and improper designation of William Ackerman

Jacksons withdrew their request to cross list Ackerman as a fraud expert.

      4. Late requests from MJ Estate

January 2013 Katherine's lawyers filed a request from MJ Estate asked Estate to give them documents from AllGood and Lloyds lawsuits. Judge states that AEG has no standing to oppose to late requests from MJ Estate. Judge states both parties can request documents from MJ Estate.

      ---------------------------------------------------------

      Request about Lloyd’s depositions

Katherine’s lawyers also served AEG with a request for all deposition transcripts and discovery and responses at Lloyds lawsuit on April 15. AEG is citing protective order on that case and refusing to turn those over to the Jacksons. No ruling posted on the online court system yet.

      Rulings on motions in limine

Most of these motions were filed conditionally under seal so in most instances it’s impossible to tell what the main arguments are.

Judge starts both ruling stating that whether Murray was hired by AEG or not is a question for the jury to decide and therefore experts cannot provide an opinion that Murray was hired by AEG but they can answer hypothetical questions that assume Murray was hired by AEG.

      AEG’s motion in limine

Exclude Jacksons expert Dr. Wohlgelernter (opinion 2) - Denied

Judge says Jacksons expert can testify that the equipment request by Murray was unconventional (red flag) for a 50 year old man with no heart disease. Judge says AEG’s expert can argue that the equipment request was for dehydration. Judge points out the jury will decide on what the reason for the equipment was and what AEG known or should have known about the request.

Exclude Jacksons expert Dr. Schnoll – Denied in part, granted in part

Granted in regards to opinions 1, 3, 14 : Jacksons withdrew opinions that “it was common knowledge that MJ had drug problems” and “AEG knew MJ had insomnia”. The opinion of “AEG’s choice of Murray killed MJ” is excluded as it’s argumentative.

“Murray was in a conflict of interest that lead to poor decisions as it concerns treatment for narcotics addiction” is permissible.

Denied as to opinions 2 and 4-13 : AEG’s opposition is based on the fact that Dr. Schnoll’s opinions are based on his assumptions such as “AEG knew MJ had Trouble sleeping”. Judge states this is not a reason to exclude these opinions and AEG can attack the foundation of such opinions during testimony.

Exclude Jacksons expert Dr. Shimelman – Denied in part, granted in part

Denied as to opinions 1, 3-7, 9-12: As in the case of Dr. Schnoll these opinions are based on assumptions and again the judge points out AEG can attack the foundation of such opinions during testimony.

Granted in regards to opinions 2 and 8: Jacksons withdrew opinion 2. Judge excluded “ AEG was the only entity that could stop MJ’s addictions” as it’s pure speculation.

Judge also points out that Dr.Shimelman’s testimony is repetitive of Dr. Schnoll’s testimony in many points and expects that Jacksons will tailor their questions to these experts so it won’t be repetitive.

      es geht weiter:
    • Exclude Jacksons expert Dr. Czeisler – Denied in part, granted in part

Denied as to opinion numbers 1-6 and 8
Granted as to opinion numbers 7 and 9
(No explanation given on judge’s ruling as what these opinions are)

Exclude Jacksons expert Arthur Erk– Denied in part, granted in part

Granted only as to the Tier 2 damages except future tours and royalty bump (which are permitted).

Court agrees with AEG that speculative damages are not allowed and this is Why most of the items in Tier 2 such as amusement parks etc are excluded.

Judge says as MJ in the past participated in endorsement deals, clothing lines and movies, doing these in the future are considered as potential loss of income and not as “speculative”. Judge states that AEG can point out MJ’s failed endeavors in the past in their cross examination.

Exclude Jacksons expert Peter Formuzis– Denied in part, granted in part

Denied as to present value calculations, granted as only the opinions about future lost earnings and earnings capacity.

Exclude Jacksons expert Jean Seawright– Denied in part, granted in part

Granted as to the opinions that “AEG hired Murray” or “AEG was careless in their supervision of Murray “as it’s argumentative and a decision for jury. Denied as to human resources practices and standards.

Exclude Jacksons expert David Berman– Denied in part, granted in part

Granted as to the opinions that “AEG hired Murray”, “AEG put the tour happening over and above health of MJ” and also Berman’s opinions about who – AEG personnel or others – are credible or not. All of these are argumentative and is a question for the jury to decide.

Denied as to music artists management and relationships. Judge states Berman’s opinions based on his “common sense” is okay as long as they also rely on his 44 year experience in music industry.

Exclude Jacksons expert Dr. Matheson– Denied in part, granted in part

Granted as to the opinions that “AEG hired Murray” and “conflict of interest caused MJ’s death or was a substantial factor in MJ’s death” as they are argumentative and is a decision for jury.

Denied as to the opinions of ethics and conflict of interest among a physician (Murray), patient(MJ) and a third party(AEG). AEG had tried to exclude Dr. Matheson saying that he was a sports medicine expert and not a tour doctor. Judge finds out that Dr. Matheson’s expertise about doctor, athlete and coach/team owner is relevant and comparable to this situation.

      Jackson’s motion in limine
Entscheidungen zu Anträgen von den Jacksons

Exclude AEGs expert Eric Briggs – Denied in part, granted in part
      Ausschluss von AEG-Experten Ercic Briggs

Granted as to the income / value of MJ Estate and its effect on damages. Jacksons also agreed that they will not introduce post-death increase in the value of MJ Estate and argue that the increase is an indicator of MJ’s earnings had he lived.
Zugestimmt bzgl.

Denied as to MJ’s future earning potential – media/ entertainment rights.

Exclude AEGs expert William Ackerman – Denied in part, granted in part
      Ausschluss vom AEG-Experten Ackermann

Granted as to the amount Jacksons receive from MJ Estate including TII film proceeds.
Zugestimmt in Bezug auf das was Jacksons erhalten vom MJ Estate einbezogen TII-Film-Prozente

Denied as to MJ’s debts as MJ’s financial condition at the time of his death has relevance to his future earnings potential.

Exclude AEGs expert Arnold Dicke – Denied
Abgelehnt der Ausschluss von AEG-Experte Arnodl Dicke

Dicke – an actuarial- has said he cannot testify to the exact number of years MJ would have lived however the judge has ruled that he can testify to a range of years, a general opinion of life expectancy and any deviation from standard life expectancy tables.

Exclude inquiry of business dealings and personal life of Jacksons experts Barry Nadell - Denied

Judge states Nadell has many other business and AEG can explore the amount of time – if any- Nadell actually spends on his background investigation business. Furthermore judge states Nadell’s testimony in which he said he didn’t realize his facebook was public implicates credibility and expertise in background investigations.

Exclude AEGs expert Rhoma Young – Denied in part, granted in part
      Ausschluss von AEG Experte Young

Granted as to the opinion of “Murray was not hired”

Denied as to the opinion that “negotiations for an independent contractor” (more about this below).

      -----------------------------------------------------------

      Independent contractor versus Employee
      Unabhängige Auftragnehmer gegen Arbeitnehmer

AEG and Jacksons were having disagreements about in regards to independent contractor and employee. They asked Judge for a clarification.

AEG claims as the judge has dismissed the respondeat superior, court found that Murray was an independent contractor and not an employee.

Jackson’s disagree and say that court’s ruling did not establish any facts and Jackson’s can argue to the jury that Murray was AEG’s employee.

Judge responds to clarification as it follows :
      Gericht antwortert zur Klärung

"Plaintiffs (Jacksons) asked for clarification that the court found Murray was “as a matter of law” not an employee”. The court finds that based on evidence presented at summary judgment that it is the “law of the case” Murray (assuming he was hired) was an independent contractor and not an employee. This is so because the court summarily adjudicated Plaintiffs (Jacksons) respondeat superior claim/ theory in favor of Defendants (AEG)”

      Michael Bush Deposition

Michael Bush is one of the witnesses that is late added by Jacksons. AEG wants to depose Michael Bush before he testifies. IT's not clear if Jacksons actually plan to call him to stand.

      Conrad Murray police interview

Jacksons and AEG is arguing over Murray's interview with the police on June 27 2009. (This is the interview that was shown during the criminal trial).

AEG wants to use the interview to show that Murray said Michael asked him to be on his team, and Murray believed that he was the employee of Michael Jackson. AEG says this will show Murray's state of mind. AEG says Murray's state of mind can show that AEG and Murray never entered into a contract and it rebuts that Murray had conflict of interest or divided loyalties.

AEG points out that Jackson experts use other parts of the interview (that Murray gave Michael propofol for 6 weeks, Murray talked with AEG people at the hospital and how Detective Martinez learned 3 bags of Propofol from Murray and so on) but oppose AEG using this part of the interview. AEG calls it unfair.

AEG states statements that show state of mind, emotion, physical sensation, intent, plan, motive is admissible when they are used to show the person's state of mind and and explore or prove act of conduct of that person.

Jacksons respond to this calling Murray's interview inadmissible hearsay. Jacksons also argue that Murray's belief that he was MJ's employee is irrelevant and whether Murray was employed or independent contractor of Michael or AEG needs to be determined on the basis of several objective factors. Jacksons also ask Murray's statement about employment to be excluded because it can mislead the jury. Overall Jacksons argue that it's the jury that should determine whether Murray was hired by AEG or Michael.

AEG responds pointing out Jacksons arguing Murray's state of mind being irrelevant is outrageous. AEG argues that Murray's statements aren't hearsay because they won't be offered as truth , they will be just offered as evidence.

AEG states that they don't plan to use the statements to argue or prove that Murray was Michael's employee. They say that the statement shows that Murray did not consider himself to be contractually bound to AEG Live. Similarly AEG argues Murray's subjective belief as who he was actually working for is relevant to determine whether in fact Murray could have felt the pressure claimed by Jacksons. AEG argues Murray could not have felt pressure from a conflict he did not know existed. AEG states Murray's statement shows Murray did not believe he was in the service of AEG Live at the time he treated Michael, is admissible to show his state of mind.

(Note: These last set of documents also again reference that "Murray was at most an independent contractor is the law of the case")

Payne saw "their loyalty to their father" and their father "enlightened them and taught them," he testified. "I was very proud to see Michael as such a loving father."

His description of the close relationship Paris, 15, and Prince, 16, had with their father four years ago could foreshadow the significance of the children's testimony later in the trial.

Paris, who was 11 at the time, was "a very retentive young lady who was very, very smart, very astute," Payne testified.

"She had full knowledge of the day-to-day operations, from the time of lunch and what it was going to be, she was hands on -- far beyond her age," he said. "She had a lot of responsibility, which I think she welcomed.

    • Kai Chase Aussage 18.6.2013

Summary of Kai Chase testimony yesterday from different sources:
Zusammenfassung Kai Chase Aussage aus verschiedenen Quellen (Engl. Text so gefunden i. Facebook)

Kai Chase working for MJ as his personal chef end of March, was let go in May and brought back in June 09. Not trained as nutritionist. She currently works for Katherine Jackson and MJ's children since July 2012. Chase met with MJ’s assistant Michael Amir for her first interview. The second meeting happened at the Carolwood house. Michael Jackson was not present, the meeting was with MJ's children. "They were talking over each other, they very excited to meet me," Chase said. "They wanted to make sure I knew how to cook healthy food".

Chase recalls the kids saying daddy likes apricots, we like fruits, Blanket likes mango. It felt like we were developing an immediate bond. It was a beautiful beginning." Chase said she began working the very next day, end of March. Chase's schedule started with 7 days a weeks, eventually became 6 days a week, Sundays off. Chase said first MJ encounter they kind of had the introduction, like bumped into each other. "After that it blossomed into a boss/friend relationship". Chase said MJ was very hands on into his children's life/nutrition. "He wanted to get to know the woman who was feeding his children." The relationship between MJ and his kids was very loving, they were together a lot. His children were the love of his life, his children meant everything to him. MJ had lunch with his children privately.

The house was very warm, good feeling, loving. It was a beautiful place, music playing, sometimes classical music, sometimes Disney music, fireplace on, she described. The soundtrack in the kitchen at Michael Jackson’s home was LA’s K-Earth 101 station. Chase said that when they ate food from other parts of the world they would study a bit about the culture of the place they were eating. Chase would write the menu on chalkboard of what the meal was for the day, so kids could understand the food they were eating. Chase said the children were homeschooled from Monday to Friday, so Mr. Jackson liked to keep things creative. Chase gave as example Monday was reading day, Tuesday was arts and crafts, Wednesday was watching classic movie then writing about it. Chase said the kids learned math, science, foreign language. They had a teacher come in, they were constantly being educated. "He took great pride helping children develop foreign language and art," Chase testified.

"The children weren't allowed to watch television or use computers". Chase said she stayed a lot in the kitchen, but since it was an open floor plan, she got to interact with the children. Chase got to see the interaction of MJ with the children. She said it was a family atmosphere. Chase described how the children reacted when MJ arrived at the house. Chase: Seeing those children take off like lightening, grab him by the ankle, by the arms, it brings tears to my eyes, so much love there.

MJ was disciplinary when needed, Chase said. When they had school, they had to be in bed by certain time; respected and obeyed their father. Chang: Were they allowed to eat sweets whenever they wanted? Chase: No. no! "Sweets were only dictated when he (MJ) said," Chase explained. Chase asked MJ if she could do comfort food Saturday, serving not-so-healthy food like fried chicken. MJ gave her the thumbs up, she said. It was a way to break the monotony of always eating healthy.

Chase said Michael had a very giving spirit, loving nature spirit. The chef testified MJ was always concerned on how to give back. Chase testified the house had animals: dog labrador whose name was Kenya, 2 cats whose names were Katie and Thriller, a talking bird named Siberia who whistled for pretty women, a rabbit, and Prince had a pet rat. Chase said the kids were responsible and helped with the animals. Chase told a story about one night going into the backyard of the mansion and collecting snails with Paris Jackson for a science project. When they returned, Michael Jackson was waiting for them. “At this point I knew I was going to get fired,” she said. She wasn’t. Instead, Michael Jackson helped make a comfy box for the snails, complete with moss, cocktail umbrellas. Box stayed in the kitchen.

MJ's relationship with kids was warm, loving. "These are my babies," Chase said MJ would say. “Did MJ have a good sense of humor? Chase: Yes, he was a practical joker”. On chalkboard, there's a message Paris wrote: "I love daddy! Smile, it's for free". Chase didn't recall if it was written the day MJ died. MJ ate chicken, fish and turkey, no pork or beef. Chase said MJ loved Mexican food, she did vegan ground beef tacos, one of his favorites. Prince liked to have same portions as Daddy. Chase explained she did a lot of juicing for him with beets, organic vegetable, lots of lean protein.

Paris celebrated her 11th birthday in beginning on April. Chase said MJ told the children they could eat anything they wanted that day. Paris chose to decorate party with everything Michael Jackson. They had cheese pizza, hot wings, banana split, Chase said. MJ then took his children to the backyard where he had this Cirque du Soleil type of performance for her. "They sat there and watched," Chase said. "And I cried."

She said MJ was very excited about what was happening, was excited to have his children see him perform. Chase said that MJ would come to the kitchen dressed sharply, black Levi's pants, with Tom Ford cologne (Black Orchid). "Prince actually told me his daddy wanted me to go to London for the tour," Chase testified. Kids' nanny was Grace Rwamba. Chase described her very warm and loving. "This is the mother that they knew, had been with them since birth". "I was told she was let go," Chase said.

    • "I was let go in beginning of May by Michael Amir," Chase said. Chase said she was told there had been a change in management. Chase argued her rate is negotiable. "I was feeding Mr. Jackson and his children, my rate is negotiable, you have to let me go to London." Chase said she was told in person 'let me see what I can do' and next day she got call saying don't need to come in, you're fired. "I pleaded with him" Chase said. She didn't get to say goodbye to MJ or his kids, didn't have any discussions with MJ about salary/firing. The pay was very sketchy, Chase said, sometimes she was paid on time, sometimes not paid at all. Chase said she didn't believe MJ knew she was fired because she said she believes if MJ fired her it would've happen that way.

In the beginning of June, Chase said she received a call from Michael Amir asking her to come back. Chase returned to work on June 2nd. "When I came back in June, the kids and Mr. Jackson wanted me to come back," Chase explained. The children were excited to see Chase rehired. "The day I came back, they greeted me at the door." Chase said MJ went to her and asked where had she gone, he had no idea. "I need you to keep me and my children healthy," Chase testified MJ told her. "I'm working hard, they are killing me, I need your help,". Do you remember Travis Payne? Yes he worked with K.Ortega, saw him couple times, sometimes they would show MJ what they had done, dance routine.

Chase went to Disneyland on her first day off and brought them presents. Then Paris Jackson wrote this note: “Dear Kai, Thank you for these beautiful gifts you gave us. Oh, and I'm writing this letter with the magic wand pen you gave me. I hope you like the presents & picture. And thank you for the presents for P.B. & Daddy, they like them! Lots of love”. Of all the convos she had with MJ, 50% was about family, mostly about his mother.

Chase said in April MJ was strong, healthy, active. "He looked good”. In June "The energy in the house was not the sam. He appeared very weak, he looked very much thinner, undernourished, he didn't look as well as I had seen him, it was an obvious difference, concerned me greatly”. She recalled that when she arrived at the house, the pantry and refrigerator were bare. There was Fiji water, Coca Cola, red bulls and Starbucks coffee drinks. Chase then went to Whole Foods to buy organic food for the house. She explained While Foods has a card for chefs who have personal clients. "The credit card was declined. I had no choice but to use my own to pay for food to feed him and his family," Chase said. This was not the first time credit card was denied. "Mr. Jackson, with his rehearsals and his schedule, I could see it was taking a toll on him," Chase opined.

Chase described when she observed MJ's son Prince helping Michael go up the stairs once. “I knew I had to get this man as healthy as possible, but I didn't know Why he was deteriorating”. Chase said she spoke with her parents about her concerns, but didn't know who she could take to at the house about it. Chase recalled one time seeing Travis Payne and MJ rehearsing at the house. "MJ did eat, but his portions were getting smaller," Chase said.

Chase first met Dr. Murray in the first few weeks of April. "He introduced himself to me as Michael's personal physician. I saw him more daily in June,"saying Dr. Murray wasn't around as much in April, never saw him bring anything to the house. Majority of the times I'd see Dr. Murray there in the morning," Chase testified. She assumed Dr. Murray had spent the night. Dr. Murray never discussed MJ's nutrition with Chase. "I thought it was quite strange a doctor not checking MJ's eating habits." "I asked him a couple of times, but his answer was you can fix him anything," Chase said about conversation with Dr. Murray. "My room was the kitchen, there was no reason for me to go upstairs," Chase explained about not going to the upper floor of the house.
In June "I saw Dr. Murray bring oxygen tanks down from upstairs into the kitchen," Chase recalled. Sometimes I saw them lined-up in the security booth with a sign saying "fill up every Friday." "Yes, I was concerned," Che testified. "I had no idea what they had been used for, but I never asked."
