Der MJ-Estate verklagt Tohme Tohme und sagt er habe MJ um Millionen betrogen. Demnach soll Tohme Tohme Vereinbarungen mit MJ geschlossen haben, die ihm 35000 Dollar plus Spesen zusagten unabhänig von der Arbeit die er leistet. Zudem habe Tome einen Deal verlinkt, der ihm 15% von allem garantiere was MJ verdiente. Tome habe MJ auch zu einem Kreditgeber für die Refinazierung von Neverland eingeführt. Die Estate-Anwälte rechnen mit einer Klage von Tome wegen dem Geld was er behauptet, dass ihm MJ schuldet und der Estate will ihn ausschalten bevor die Klage eingereicht ist. Der Estate fragt auch nach Schadensersatz. Michael Jackson hatte TohmeTohme 3 Monate vor seinem Tod entlassen.
Ergänzend zum TMZ-Artikel steht in den folgenden beiden Artikeln noch, dass MJ die Verträge mit Tome Tome ohne jeglichen rechtlichen Beistand unterzeichnete. MJ habe Tome 2 Power of Attorney-Dokumente unterzeichnet, die ihm außerordentliche Macht gaben. Zudem geht er darauf ein, dass Tohme Tohme Neverland leerräumen ließ und eine Versteigerung bei Julien`s anberaumte bis Jackson die Auktion mit einem Anwalt stoppte. Tome nahm Besitz über Eigentum und Geld was MJ gehörte und lagerte die Sachen in verschiedenen Lägern und der Estate habe nach MJ`s Tod Schwierigkeiten gehabt den Besitz zurückzubekommen. Pech für Tome, dass der Julien`s Katalog das gesamte Inventar von Neverland dokumentierte.
]Bestandteil der Klage ist auch die Kunstkollektion. Der Estate sagt Tohme Tohme habe 2008 einfach die gesamte Kollektion an den Künstler Brett Livingstone Strong gegeben. Der Estate sagt Tome habe seine Power of Attorney missbraucht um Strong Copyrights zu geben die Michael besitzt. Die Kunst lagert derzeit in einem Hangar.

Michael Jackson's Estate is going after Tohme Tohme, MJ's former manager, claiming he fleeced the singer out of millions of dollars.

TMZ has obtained legal docs filed by the Estate, claiming Tohme got Michael to sign agreements that earned him a fortune for doing nothing.

According to the papers, Estate attorney Howard Weitzman claims Tohme got MJ to agree to pay him $35,000 a month plus expenses as a flat fee -- regardless of what work Tohme performed. On top of that, Tohme inked a deal that gave him 15% of any money Michael made.

And there's more ...Tohme introduced Michael to a lender that refinanced Neverland. In return, Tohme got Jackson to pay him $2.4 million -- just for the introduction. And Tohme got MJ to promise him 10% of any profits if the Ranch was sold.

Tohme also got MJ to agree to pay him $100,000 a month for the "This is it" tour.

Estate lawyers are anticipating a lawsuit by Tohme against the estate for the money he claims he's owed, and the Estate wants to shut him down before a suit is filed.

The Estate is also asking for damages.

BTW, Michael fired Tohme 3 months before he died.

Michael Jackson Executors (Finally) Sue Singer's Final Manager

Michael Jackson‘s estate has finally filed a lawsuit against Tohme Tohme, who used to call himself “Doctor.” Tohme was Michael Jackson’s penultimate manager–meaning he was replaced just before Jackson’s death by Jackson’s longtime manager and friend, Frank DiLeo. But Tohme, the estate says in a complaint filed by attorney Howard Weitzman, ran amok during his short term between January 2008 and March 2009. It was Tohme, working for Thomas Barrack‘s Colony Capital, who pulled off the sale of Neverland to Colony. But according to the complaint, Jackson never understood that Tohme was also going to receive a finder’s fee for doing work for his own employer. Jackson had no lawyer representing him in his many signed agreements with Tohme, and so didn’t understand that when Colony came up with $24 million to bail out Neverland, Tohme would get $2.4 million.

Tohme, the complaint further reads, got Jackson to sign an agreement paying him $35,000 a month. He was also to receive 15% of all gross compensation Jackson received for anything he did in the entertainment field. Jackson signed not one but two Power of Attorney documents giving Tohme “extraordinary” powers. He also gave himself a $100,000 per month producers fee for the run of Jackson’s London concert dates–from July 2009 through at least March 2010. All of this Jackson signed without a lawyer, and despite numerous stories (many written by yours truly) about Tohme’s many assertions about his credentials being false.

It was during Tohme’s regime, for example, that the contents of Neverland were emptied and consigned to an auction house in Beverly Hills. The auction didn’t proceed when Jackson finally got a grip, and a lawyer, stopped the auction. Tohme then took back the contents and warehoused them. When Jackson died, the estate had to negotiate with him to get back the property. Out of luck was Julien’s Auction House, which published a now collectible catalog of everything that had been in Neverland.

On a side note, Tohme used to claim he was a doctor from Lebanon. But he could never prove to me that he was a doctor and when I questioned him about it in 2008, he told me wasn’t practicing. He did say he was Ambassador at Large to Senegal, but their Embassies denied it.

Jackson Estate Lawsuit: to Reclaim $900 Mil Art Collection

Part of the lawsuit filed today by Michael Jackson’s executors has to do with a $900 million art collection. It’s hard to believe, considering Jackson’s perilous fortunes when he was alive, that such a collection existed. But last summer LA Weekly visited a Santa Monica airport hangar where Jackson was stowing his personal art collection–art he had created and a few other tchotckes. At one time, Star Magazine (ahem) got an appraisal of $900 million for all this stuff. More importantly, the estate says that in 2008, Tohme Tohme, Jackson’s then manager, simply gave the whole collection to a Los Angeles artist named Brett Livingston Strong. Strong — and Jackson– have called this man a “modern day Michelangelo.” Anyway, the estate claims in its suit againt Tohme that he improperly used Powers of Attorney to give Strong copyrights that Michael owned. Ich glaube der springende Punkt ist, dass er diese Generalvollmachten ( ) ohne Beisein eines Anwalts vergab.
Ich denke das ist der Punkt wo das Estate ansetzt. Und durch das Stoppen der Juliensaktion hat Michael auch gezeigt, dass er damit ganz und gar nicht einverstanden war/es nicht geduldet hat, was Thome tat.
Einfach wird es bestimmt nicht.. aber der zwielichtige Typ.. hat der nicht nach seiner Kündigung durch Michael behauptet, dass er noch weiter Michael vertritt?
Das alles könnte sich summieren und seine 'Lauterkeit' gehörig in Frage stellen.
Dem Estate geht es ja wohl auch darum, den ersten Schritt zu machen, bevor Thome den macht.
Das ist wohl juristische Spitzfindigkeit.

Allerdings erinnert es mich auch an die Beendigung der Geschäftsbeziehung mit Branca und der Aufforderung ALLE Dokumente/Gelder etc. auszuhändigen.
Das Testament wurde dabei wohl i-wie 'vergessen'.. oder woher hatte M. Branca das Schriftstück sofort zur Hand..

Ich denke es geht hier hauptsächlich um Michaels Kunstsammlung, die Michael ja L.Strong durch/mit einem Schreiben von Tohme L.Strong geschenkt haben will. Diese Sammlung weist ja einen beträchtlichen Wert auf. Ich kann mir schon vorstellen, dass der Estate auf diese Sammlung nicht verzichten will.

Es geht sicher nicht hauptsächlich um die Kunstsammlung. Tohme ist ja offensichtlich im Besitz noch von reichlich Eigentum von Michael, dass er nicht zurückgab. Zudem fordert er 15% allen Einkommens von 2008 bis in die Gegenwart.

Mich persönlich würde interessieren was Tom Barrack von dieser Klageschrift hält. Besteht nicht eine direkte Verbindung zwischen Colony Cap. und Tohme? Ich habe das so in Erinnerung.

Boah, er wird Zeit, dass dieser Parasit zur Rechenschaft gezogen wird. Viel zu lange konnte er sich aus diesem Geschehen fernhalten und
seine Schäfchen ins Trockene bringen.
Ich verstehe von diesen Verträgen nicht viel, aber für mich sieht es nicht danach aus, dass Michael aus Vertrauen diese Verträge unterzeichnet hat, sondern aus purer VERZWEIFLUNG. Wie sagte ein Dieter Wiesner sinngemäß: Michael musste 2008, als er von Las Vegas wieder nach LA zog, seine Koffer alleine packen. Wo waren denn all seine alten „Freunde“, „Geschäftspartner“, „Anwälte“... ?

Das, was da jetzt ans Tageslicht kommt, erkennt doch sogar ein Laie, dass es nur auf Michaels Kosten geht. Auch ihm wird das bewusst gewesen sein.

Ich vergleiche es mal mit einem Kredithai. Jeder weiß, wenn man denen in die Finger gerät, kommt man so gut wie gar nicht mehr auf die Beine. Und doch entscheiden sich Menschen in ihrer Verzweiflung sich dort Geld zu leihen, weil sie keinen anderen Ausweg mehr sehen, weil sie von allen allein gelassen wurden und um kruz einmal durchatmen zu können.
Vielleicht liege ich auch falsch, aber so empfinde ich die Sache.

Ich bin wütend, traurig und speechless. Ich hoffe so inständig, dass die Klage zum Erfolg führt und der Nächste für sein widerwärtiges, egozentrisches, unmenschliches…Verhalten bestraft wird.

Einer nach dem Anderen soll zur Rechenschaft gezogen werden.

Eine Stellungnahme von Barrack würde mich auch interessieren. Mich würde aber auch eine Stellungnahme von Jermaine interessieren, der Tohme Tohme bei Michael einführte. Sagt er ja selbst in seinem Buch. Und ich glaube dort stellt er Tohme nicht als schlechte Person. Aber bitte Korrektur falls ich mich irre, denn ich habe das Buch selbst nicht gelesen und nur Auszüge mitbekommen.

Stelle den Artikel auch noch mal ein und markiere nur das was aus dort der Gegenklage von Tohme zitiert wird. Die haben wir ja leider derzeit noch nicht zur Einsicht vorliegen.

Tohme betrachtet sich ja quasi als weiterer Erbe neben Kathrine und den Kindern.

TMZ zitierte aus der Gegenklage von Tohme ja schon, dass der Titel TII seine Idee war und wenn Michael dies in einem hochsprituellen Ton verkaufen wird, dies ein Hit werden wird.

LOS ANGELES (AP) — A legal war erupted Friday over earnings from Michael Jackson's estate with a former manager claiming a 15 percent stake and the singer's executors seeking to block any payments to the former adviser.

Attorneys for Jackson's estate and Tohme R. Tohme filed dueling cases over the adviser's claims that along with Jackson's mother and three children, he is entitled to a sizable share of the singer's post-death earnings. The estate has earned more than $300 million since Jackson's June 2009 death.

Jackson's estate claims Tohme used undue influence to get Jackson to sign several deals that lined his pockets and that he improperly gave away some of the singer's property. The contracts involved a refinancing of Jackson's debt related to Neverland Ranch and a producer's fee that Tohme negotiated for himself for Jackson's series of planned comeback concerts in London.

Tohme's lawsuit, filed in Santa Monica, Calif. claims he was influential in reviving Jackson's career after he was acquitted of child molestation charges. His lawsuit states he worked diligently to create "a financial and career strategy that would provide stability for Michael Jackson and his children."

Estate attorney Howard Weitzman wrote in a statement released Friday morning that he expected Tohme to file suit and that the estate was asking a probate judge to block the former adviser's claims.

"We believe the facts will show that Mr. Tohme's claims are meritless and that Mr. Tohme engaged in wrongdoing with respect to Michael Jackson starting early in their relationship," Weitzman wrote.

Tohme served as Jackson's manager from January 2008 until March 2009. His suit claims he was instrumental in getting the singer to move to Los Angeles to prepare for a career comeback and was key to the singer signing an agreement with AEG Live for a series of comeback concerts in London dubbed "This is it."

Rehearsal footage was turned into a film of the same name, and Tohme was credited in the picture as Jackson's personal adviser.

Jackson's estate however contends that Tohme has improperly retained Jackson's property and financial records and forced the singer to sign unconscionable contracts. One of the deals, which dealt with the refinancing of debt on Neverland Ranch, called for Tohme to receive $2.3 million. Tohme also negotiated a producer's fee of $100,000 a month for the "This is it" shows planned in London, although Jackson died before the concert series began.

This lawsuit is necessary to finally put a stop to abuse of fiduciary obligations owed to Jackson and seeks to unwind the self-serving and unconscionable agreements (Tohme) encouraged Jackson to enter into" and to compensate the estate for failing to return Jackson's property, the estate's complaint states.

Tohme's lawsuit notes that he returned $5.5 million to Jackson's estate in July 2009. He told The Associated Press at the time that the singer had stockpiled the money to purchase a "dream home" in Las Vegas.

Tohme and the estate have been battling over payments for more than a year.

2007 when in Africa in a business meeting trying to find a backer for the project, a friend mentions Tohme Tohme as a guy "who knows a lot of people". March 2008 Jermaine and Halima goes to meet Tohme. Not charming but gracious. Jermaine discusses Crystal City to Tohme without mentioning Michael. 4 meetings with Tohme. Tohme says he'll try to come up with oil-rich investors to fund $6billion and report back.

Neverland foreclosure news. Jermaine worries that Michael would need to sell his catalog to save Neverland. He decided to call Tohme. Halima says "you hardly know The Man". April 2008 Jermaine meets with Tohme , tells him the situation and asks if he knows anyone that can help. Tohme says Tom Barrack / Colony Capital would help and "he'll make sure of it". Jermaine goes to Las Vegas to talk to Michael. Security doesn't let Jermaine in. He goes to a hotel and comes back 3 times, still they don't let him in. He calls Katherine who calls Grace who lets Jermaine in. Jermaine complains about the security not letting him in. Michael tells him he'll make changes soon. Jermaine tells Michael about Tom Barrack.

"I know that my sister La Toya has said she wished she could have “protected” him from the likes of Tohme-Tohme, but had she known the history and the dire reality of the situation, I doubt she’d have held such an opinion."

Jermaine takes Tohme to meet Michael. Michael talks with Barrack on the phone. Meeting with all of them is set. Shortly before foreclosure Barrack pays $23M and gets 50% ownership at Neverland. Barrack and Tohme are heroes. Tohme becomes Michael's manager. Tohme looks over Michael's finances. Cash poor, asset rich. a lot of expenses.

2008 summer Michael shows Jermaine the photos of the house he wants to buy in Vegas that belonged to Prince Jefri of Brunei. He saw the house in 2007, decided to buy it in 2008 and was in negotiations in 2009 to make a $15M down payment for it funded by his TII contract.

Michael and Barrack get along very well. Barrack wants to open a thriller tower in his Hilton hotel. Michael asks him if he wants to partner with him on Sony/ATV catalog. Jermaine doesn't want to leave Michael vulnerable to Barrack and Tohme so he tries to recruit lawyer Joel Katz and Michael agrees. Tohme turns against Jermaine as he brings in a lawyer. Neverland auction. Michael approved it thinking only furniture in storage will be sold. He did not want Neverland would be dismantled and his personal possesions be sold. Michael soon fires Tohme.

Jermaine says before his firing even Tohme turned into a gatekeeper not allowing him to see Michael.

“I don’t understand Why you keep coming around. Your brother does not want to see you. If someone does not want to see you, I wouldn’t keep humiliating myself and showing up . . .”

March/ April 2008 dinner with Barrack is when TII idea started. TII is one way to earn big money or he would have need to work at McDonald's as he told Karen Faye. Jermaine says Michael long dreamed a residency tour - in Paris. Tohme reaches out to AEG and Live Nation. Jermaine knows AEG because he talked to them in 2004 about a Broadway musical about Jacksons life story. 2008 Barrack seals the deal with Phil Anschutz of AEG for TII that came with a minimal payment of $36.5M with an upside potential of $300M. 3 movies were a part of it as well as the $15M Vegas home. Also an agreement to do spot concerts as well as 2 tours. One of the tours would be a Jackson 5 reunion tour because Katherine had told Michael that before she died she wanted to see her sons tour together one last time. One more solo tour as final curtain call. He said he would retire from music at when he was 55 years old and then only focus on Hollywood for movies.

TII announcement. Michael being late, not staying long etc. Jermaine says earlier that day Michael learned that guitar player David Williams died.

May 14, 2009 Family day. Katherine and Joe's 60th anniversary surprise. Michael is 4 weeks into TII rehearsals.

"When I spoke with my brother at the Indian restaurant, there was no question that he was fit, healthy and focused. He was skinny, but only in an athletic sense, and the photos that still stand on an end table in my living room confirm it.
