    Ich hoffe, ihr löscht das nicht - weil ich es nicht übersetzt habe, aber es ist mir einfach zu lang. Eine kurze Zusammenfassung davon ist quasi das, was ich im Newsticker übersetzt habe.

    In diesen Thread empfiehlt es sich übrigens nach jedem Prozesstag reinzuschauen, da Ivy jeden Tag anhand der Presseartikel und Pressetweets aktualisert. Es ist meines Erachtens die umfangreichste Zusammenfassung, die man von einem Prozesstag derzeit (ohne Transcripts) haben kann. Prozesstag 2 ist auch schon eingestellt.

    Mit dem Google-übersetzer lässt sich der Inhalt grob zusammengefasst verstehen. Dass hier leider nicht alles übersetzt werden kann, ist schade, aber auch verständlich.
    Sollte mal etwas völlig unklar sein, werden die Fragen bestimmt beantwortet. Da bin ich ganz sicher.

    AEG attorney opposed to Rebbie’s presence as she might be a witness (LATimes). Judge Yvette Palazuelos had ordered that only one Jackson family member accompany Katherine Jackson.     Months after MJ's death, LAPD detectives spoke with Gerard White -- whose father died 6 days after Dr. Murray operated on his heart in Las Vegas back in 2007.


    White told investigators Murray not only botched the surgery and ripped a hole in his dad's heart -- but he failed to recognize obvious, tell-tale signs that his patient was fatally wounded.


    Gerard told investigators he and his family contacted a lawyer to go after Dr. Murray -- but they couldn't find an attorney who would take the case because there wasn't enough money to be made.


    Gerard also said that after his father died, Murray did "exactly what he's doing in the Jackson case" ... because he never attempted to speak with his family members about the situation.


    Murray's rep tell TMZ Gerard's story is "hearsay and totally unsubstantiated."


    The rep adds, "Murray has medical insurance for lawsuits. If an attorney thought Gerard White had a case he surely could have been paid. The fact that White couldn’t find a lawyer to take the case tells me White's claims most likely had no merit."

    The added documents show that this appeal is filed by Katherine Jackson and it’s about judge’s decision to dismiss the complaint against AEG Inc. and Tim Leiweke. In other words Katherine’s lawyers are asking the Appellate court to reverse the judge’s order of dismissing the complaint against AEG Inc and its CEO.

    MJ Estate’s motion to seal medical record


    Estate’s motion to seal medical records is denied and the medical records are ordered to get unsealed.

    Most of these motions were filed conditionally under seal so in most instances it’s impossible to tell what the main arguments are.


    Judge starts both ruling stating that whether Murray was hired by AEG or not is a question for the jury to decide and therefore experts cannot provide an opinion that Murray was hired by AEG but they can answer hypothetical questions that assume Murray was hired by AEG.

    Judge says Jacksons expert can testify that the equipment request by Murray was unconventional (red flag) for a 50 year old man with no heart disease. Judge points out the jury will decide on what the reason for the equipment was and what AEG known or should have known about the request.

    “Murray was in a conflict of interest that lead to poor decisions as it concerns treatment for narcotics addiction” is permissible.

    Judge also points out that Dr.Shimelman’s testimony is repetitive of Dr. Schnoll’s testimony in many points and expects that Jacksons will tailor their questions to these experts so it won’t be repetitive.

AEG had tried to exclude Dr. Matheson saying that he was a sports medicine expert and not a tour doctor.     Michael Bush Deposition


    Michael Bush is one of the witnesses that is late added by Jacksons. AEG wants to depose Michael Bush before he testifies. IT's not clear if Jacksons actually plan to call him to stand.
    Michael Bush ist einer der letzten aufgelisteten Zeugen der Jacksons. AEG möcht ihn vernehmen bevor er aussagt. Derzeit nicht klar ob Jacksons ihn planen aufzurufen.



    Conrad-Murray-Polizei-IV
    AEG und die Jacksons haben Unstimmigkeiten zur Nutzung von Murrays Polizeinterview (aus dem Strafprozess) in diesen Prozess. AEG will das IV einbringen um Murrays Geisteszustand/Verfassung zu zeigen und das er sagte für Michael zu arbeiten. AEG sagt Murrays Glaube, dass er für Michael arbeitete widerlegt die Behautpung der Jacksons, dass er unter Druch von AEG stand. Die Jacksons bezeichnen das IV als ausschließbares Hörensagen und die Jury solle entscheiden ob Murray von AEG oder Michael eingestellt wurde.

AEG sagt, sie wollen das IV nicht als Wahrheit oder Beweis einbringen, wer Murray anstellte. Es soll ein Beweismittel für Murray`s Geisteszustand/Verfassung sein.


    Conrad Murray police interview


    Jacksons and AEG is arguing over Murray's interview with the police on June 27 2009. (This is the interview that was shown during the criminal trial).


    AEG wants to use the interview to show that Murray said Michael asked him to be on his team, and Murray believed that he was the employee of Michael Jackson. AEG says this will show Murray's state of mind. AEG says Murray's state of mind can show that AEG and Murray never entered into a contract and it rebuts that Murray had conflict of interest or divided loyalties.


    AEG points out that Jackson experts use other parts of the interview (that Murray gave Michael propofol for 6 weeks, Murray talked with AEG people at the hospital and how Detective Martinez learned 3 bags of Propofol from Murray and so on) but oppose AEG using this part of the interview. AEG calls it unfair.



    AEG states statements that show state of mind, emotion, physical sensation, intent, plan, motive is admissible when they are used to show the person's state of mind and and explore or prove act of conduct of that person.


    Jacksons respond to this calling Murray's interview inadmissible hearsay. Jacksons also argue that Murray's belief that he was MJ's employee is irrelevant and whether Murray was employed or independent contractor of Michael or AEG needs to be determined on the basis of several objective factors. Jacksons also ask Murray's statement about employment to be excluded because it can mislead the jury. Overall Jacksons argue that it's the jury that should determine whether Murray was hired by AEG or Michael.


    AEG responds pointing out Jacksons arguing Murray's state of mind being irrelevant is outrageous. AEG argues that Murray's statements aren't hearsay because they won't be offered as truth , they will be just offered as evidence.


    AEG states that they don't plan to use the statements to argue or prove that Murray was Michael's employee. They say that the statement shows that Murray did not consider himself to be contractually bound to AEG Live. Similarly AEG argues Murray's subjective belief as who he was actually working for is relevant to determine whether in fact Murray could have felt the pressure claimed by Jacksons. AEG argues Murray could not have felt pressure from a conflict he did not know existed. AEG states Murray's statement shows Murray did not believe he was in the service of AEG Live at the time he treated Michael, is admissible to show his state of mind.

    Kai Chase working for MJ as his personal chef end of March, was let go in May and brought back in June 09. Not trained as nutritionist. She currently works for Katherine Jackson and MJ's children since July 2012. Chase met with MJ’s assistant Michael Amir for her first interview. The second meeting happened at the Carolwood house. Michael Jackson was not present, the meeting was with MJ's children. "They were talking over each other, they very excited to meet me," Chase said. "They wanted to make sure I knew how to cook healthy food".

They had a teacher come in, they were constantly being educated. "He took great pride helping children develop foreign language and art," Chase testified.

She didn't get to say goodbye to MJ or his kids, didn't have any discussions with MJ about salary/firing. The pay was very sketchy, Chase said, sometimes she was paid on time, sometimes not paid at all. Chase said she didn't believe MJ knew she was fired because she said she believes if MJ fired her it would've happen that way.

"When I came back in June, the kids and Mr. Jackson wanted me to come back," Chase explained. The children were excited to see Chase rehired. "The day I came back, they greeted me at the door." Chase said MJ went to her and asked where had she gone, he had no idea. "I need you to keep me and my children healthy," Chase testified MJ told her. "I'm working hard, they are killing me, I need your help,". Do you remember Travis Payne? Yes he worked with K.Ortega, saw him couple times, sometimes they would show MJ what they had done, dance routine.

"I thought it was quite strange a doctor not checking MJ's eating habits." "I asked him a couple of times, but his answer was you can fix him anything," Chase said about conversation with Dr. Murray. "My room was the kitchen, there was no reason for me to go upstairs," Chase explained about not going to the upper floor of the house.
    In June "I saw Dr. Murray bring oxygen tanks down from upstairs into the kitchen," Chase recalled. Sometimes I saw them lined-up in the security booth with a sign saying "fill up every Friday." "Yes, I was concerned," Che testified. "I had no idea what they had been used for, but I never asked."
