California Medical Board Subpoenas Dr. Arnold Klein, MJ's Former Physician

California Medical Board Subpoenas Dr. Arnold Klein, Michael Jackson's Former Physician
    Posted on Dec 02, 2011 @ 05:00PM

By Jen Heger - Radar Legal Editor

The California State Medical Board has formally subpoenaed Michael Jackson's former physician and long time friend, Dr. Arnold Klein to appear at a hearing on December 15, RadarOnline.com is exclusively reporting.

Dr. Klein's lawyer, Herbert Weinberg, advised the dermatologist on November 30, via letter, that he would no longer be representing him for the California Medical Board proceedings.

The letter states: "Please be advised that our company is withdrawing as your counsel. We urge you to obtain counsel as soon as possible, as you have been subpoenaed to appear before the Medical Board on December 15, 2011. Failure to appear may result in the Medical Board petitioning the administrative courts for suspension of your license to practice."

During Dr. Conrad Murray's involuntary manslaughter trial in connection with the death of Michael Jackson, it was revealed that Dr. Klein gave Jackson staggering amounts of the powerful painkiller, Demerol when he would get Botox injections.

Dr. Klein didn't testify during Murray's trial, but Jackson's medical records while under his care were presented by Murray’s defense. Over a three day period in April 2009, Jackson received a whopping 775 milligrams of Demerol.

The California Medical Board wouldn't comment on what Dr. Klein will be questioned about.

Dr. Klein's lawyer, Garo Ghazarian didn't immediately respond to comment.

As RadarOnline.com previously reported, Dr. Conrad Murray was sentenced to four years in jail for the involuntary manslaughter of Jackson, who died of acute Propofol intoxication on June 25, 2009.

In 3 Tagen 775 mg Demerol :was:

    The Appeal Thread

Yesterday Murray's team indicated that they would file paperwork for an appeal either yesterday or today. This morning I watched a Flanagan interview on 'The Early Show' this morning, and he outlined the defense's rationale for an appeal:

    1. No jury sequestration
    2. Michael's financial debt was not allowed to be discussed (showed desperation)
    3. Couldn't subpena Klein, could only discuss his records
    4. Issue of bottle in evidence that contains propofol--if it is 90% propofol, that would validate the infusion theory, if 100% propofol, couldn't have been an infusion.

He said there are several other issues as well, and that they will be discussed in the Appellate court. Yesterday during the post-hearing press conference he implied that Judge Pastor was biased against his team, he was overly harsh on Murray, and that his mind was made up prior to the hearing. He said something along the lines of "Pastor's actions should be evaluated by another court of law".

One other point of interest is that he said that they consider Murray to be in danger in the general prison population. I am assuming this means that they will want him in solitary confinement."

Judge denies request by doctor convicted in Michael Jackson’s death for new testing on vial

By Associated Press, Updated: Monday, November 21, 8:40 PM

LOS ANGELES — A judge has denied a request to retest a vial of the powerful anesthetic that killed Michael Jackson.

Dr. Conrad Murray’s lawyer asked for testing on a vial of the anesthetic propofol on Friday.

(Kevork Djansezian, Pool, File/Associated Press) - FILE - In this file photo taken Tuesday, Nov. 1, 2011 Dr. Conrad Murray waits to leave the courtroom during the final stage of his defense in his involuntary manslaughter trial in the death of singer Michael Jackson. Attorneys for Murray are asking a judge to order additional testing on a key piece of evidence _ a propofol vial that prosecutors contend was used on the morning Jackson died.

Superior Court Judge Michael Pastor says Murray’s defense attorneys knew about the vial at the start of the case and could have requested the testing months ago.

Attorney J. Michael Flanagan wrote in a court filing that the testing is necessary to analyze the prosecution theory that Murray placed Jackson on an IV drip of propofol and the painkiller lidocaine then left the room.

A prosecutor argued Monday that Murray received a fair trial and there was no legal basis for the request.

Murray's star witness sanctioned by judge

By LINDA DEUTSCH AP Special Correspondent

LOS ANGELES (AP) -- A scientist who was the star defense witness in the trial of Michael Jackson's doctor has been sanctioned by the trial judge and fined $250 for violating a court order during his testimony.

Dr. Paul White, a pioneer in the use of the anesthetic propofol, said Wednesday he didn't think he was doing anything wrong when he told jurors the judge had forbidden him to testify about conversations with Dr. Conrad Murray.

Murray lawyer J. Michael Flanagan argued that White was inexperienced as a witness. But prosecutor David Walgren accused White of purposely trying to sabotage the case.

Los Angeles Superior Court Judge Michael Pastor said his instructions to White and the lawyers were clear and were disobeyed. He gave White until Dec. 16 to pay the fine or appeal.

Dr. Conrad Murray has a better chance of being struck by lightening, than getting probation for killing Michael Jackson, according to a source, RadarOnline.com is exclusively reporting.

Reports circulated yesterday that Conrad Murray's lawyers were going to ask Judge Michael Pastor to sentence Murray to probation at the convicted felon's sentencing hearing on November 29, 2011 for killing Michael Jackson.

The King of Pop died on June 25, 2009 from acute Propfol intoxication.

"Conrad Murray's lawyers can ask that their client be given probation, but he has a better chance of being struck by lightening than the judge granting their request,” a source close to the situation tells RadarOnline.com. “The fact that Judge Pastor remanded Murray into custody immediately following his conviction, well, that was clearly a sign to the defense that Judge Pastor will most likely impose the full four year prison sentence to the convicted killer.”

Jail overcrowding in California dictates that if Murray is sentenced to four years in state prison, he would serve about half of that sentence in a county jail. Murray's lawyers are hoping that if Judge Pastor does impose the full sentence, their client would be released on house arrest because the conviction is considered a non-violent felony.

"Murray's lawyers shouldn't be counting on house arrest, period. Each house arrest inmate has their case thoroughly reviewed by jail officials. Judge Pastor can order that Murray not be eligible for house arrest, but the final decision is up to the Los Angeles County Sheriff's Department. The DA, David Walgren will ask that the judge sentence him to four years in jail," an insider tells RadarOnline.com.

There was a contempt hearing Wednesday morning stemming from Dr. Paul White's comments that he made to the press about Deputy District Attorney David Walgren. The judge had imposed a gag order during the trial, and Dr. White called the DA a "scumbag" during Walgren's questioning of Dr. Steven Shafer.

"Dr. White deliberately put out evidence that was not allowed, intentionally tried to throw the case in an attempt to deny the People a fair trial," Walgren said in court. Judge Pastor agreed and fined Dr. White $250. The doctor asked if he could have 30 days to pay the fine, and the judge agreed.

Lawyer skips contempt hearing in Jackson case

By LINDA DEUTSCH, AP Special Correspondent – 52 minutes ago

LOS ANGELES (AP) — A partner of a defense attorney for Michael Jackson's doctor failed to show up for a contempt hearing Tuesday, prompting the judge to issue but hold a bench warrant for his arrest.

Superior Court Judge Michael Pastor said Matt Alford left a phone message with the court Monday saying he was in trial in Houston and could not attend. Pastor said he wants details in writing.

The judge ordered Alford to appear Nov. 29, the same day Dr. Conrad Murray is scheduled to be sentenced for involuntary manslaughter in the death of Jackson. Murray remains in jail.

Pastor threatened to hold Alford in contempt in September after he appeared on NBC's "Today" show criticizing a prosecution witness and commenting about the jury.

The judge said he was shocked because the comments came only hours after he had warned defense attorneys not to comment on the case outside court. Alford is a partner of Murray's lead defense attorney Ed Chernoff but did not participate in the trial.

The judge ordered Alford to file documents explaining Why he could not get excused from his trial in Houston to attend the hearing and whether he approached the judge there to let him go.

Another contempt hearing is scheduled Wednesday for Dr. Paul White, a defense witness who was accused of making derogatory comments about the prosecution to a reporter.

White also blurted out a comment to jurors during his testimony in possible violation of a judge's ruling.

In another bit of post-trial business, the judge accepted an apology from a Jackson fan who took a photo in the courthouse hallway during the trial.

Amy Kimes, 43, a leader of the group Justice 4 MJ, said she made a mistake.

She blamed the stress of the trial for her action in posting the photo on Facebook, but said she took it down quickly when she realized she had broken the court rule. She was banned from the courtroom for the balance of the trial.

"I don't want to add any more to the stress factor," said Pastor. "As far as I'm concerned there are no further proceedings. You did the right thing."

The Christian Conservative Billionaire Behind Michael Jackson’s Final Tour
    Bill Berkowitz's picture

    Religious Right
    by Bill Berkowitz | November 12, 2011 - 12:35pm

In case you've been on another planet, holed up in an Occupy tent somewhere, or just plain too stubborn to care, Dr. Conrad Murray has been found guilty of manslaughter in the death of Michael Jackson.

And one of the more interesting pieces of information that surfaced during the trial was the role played by Philip Anschutz, the head of the Anschutz Entertainment Group (AEG), the company that was chiefly responsible for setting up Jackson's comeback tour.

In less than two days, the 12-person jury reached its verdict. Murray was found guilty and carted off to the Los Angeles County jail where he was placed on suicide watch.

Later this month Murray, who could receive probation or as much as four years in prison, will be sentenced.

Jackson's death came while the mega-pop star was preparing for "This is it," the comeback of all comeback tours; a series of concerts at London's O2 arena. Millions and millions of dollars were at stake. Postponement or cancellation of the tour wasn't an option.

Working extremely long hours and exceedingly hard to get back into shape for the arduous tour, Jackson was unable to sleep. Murray gave Jackson the drug propofol. According to drugs.com, propofol "reduces anxiety and tension, and promotes relaxation and sleep or loss of consciousness." The powerful drug "provides loss of awareness for short diagnostic tests and surgical procedures, sleep at the beginning of surgery, and supplements other types of general anesthetics."

In its post-trial report, foxnews.com pointed out that, "The pop star had plucked the little-known cardiologist from Houston to be his personal physician."

But had Jackson really "plucked" Murray or had Murray been "plucked" for him by executives at AEG?

According to Portfolio.com's Matt Haber, "AEG was so committed to keeping the event on track, it paid ... Murray to act as the singer's personal physician."

Therefore, one of the most interesting aspects of the trial was the testimony of Randy Phillips, the chief executive of AEG Live, the company promoting Jackson's tour. According to the Los Angeles Times, "Phillips was called to the stand by lawyers for ... Murray, who had hoped his account would bolster their claim that an anxiety-ridden Jackson gave himself a lethal dose of propofol in a desperate attempt to sleep before critical rehearsals."

The Times reported that "For two hours, Phillips walked jurors through "This is it," ... from its genesis in a Bel-Air hotel suite to a final rehearsal at Staples Center that left a normally cynical music executive with goose bumps and his star performer with a great confidence.

"'He put his hands on my shoulders as we were walking out and he said to me, 'You got me here, now I'm ready. I can take it from here.' And that's the last I saw him,' Phillips recalled."

Phillips also said that the concert tour "grew out of a 2008 phone call from Philip Anschutz, the billionaire head of AEG Live's parent company. Anschutz asked him to meet with Century City financier Tom Barrack, whose company had recently purchased a note on Jackson's Neverland ranch."

Philip Anschutz is a billionaire several times over. Philip Anschutz is not a household name. He prefers it that way. In September, Forbes magazine listed Anschutz as tied for the #39th spot on its Forbes 400: The Richest People in America. He owns an assortment of enterprises ("Phillip Anschutz: The Most Powerful Billionaire You Have Never Heard Of," -- http://blog.buzzflash.com/node/12976) including the concert division that was promoting the Jackson tour, as well as London's O2 arena.

In his late-September report on the trial, Westword.com's Michael Roberts wondered whether "the case's revelations [would] splash back on Denver's ... Anschutz, who stood to profit handsomely had Jackson been able to headline the tour he was financing?" Roberts also speculated as to whether Anschutz would take a financial bath because of Jackson's death.

Roberts reported that, "Anschutz was able to turn these fiscal minuses into a plusses. By late October, he'd reportedly made back the $36 million the non-tour cost him by selling "This is it" rehearsal footage to Sony for over $60 million. And he also had a sizable piece of the This is it movie, which proved to be a cash cow as well."

AEG Live partnered with Jackson's estate to release the This is it movie. Since its release, This is it has become the highest grossing concert film in history, with over $260 million in domestic and foreign sales and nearly $45 million in US DVD sales.

Westword.com's Roberts reported that, "Anschutz wasn't pilloried for profiting from Jackson's demise, in part because he's so adept at manipulating the press. He's in the process of purchasing the Oklahoman newspaper -- the deal also includes Colorado Springs Broadmoor Hotel -- and a recent profile of him by the paper couldn't have been puffier if it'd been printed on a cotton ball.

"Indeed, the Columbia Journalism Review's Ryan Chittum made the article the centerpiece of his new column 'How Not to Cover Your Paper's New Owner.' After quoting a reference to Anschutz's belief in family values, Chittum writes, 'Is 'family values' code for 'finances anti-gay issues' and misinformation about evolution? That certainly doesn't put him out of line with political thought in my home state, of course, or with the paper's editorial history, but it's a disservice to readers not to report it. Let's face it: Anschutz is probably not buying a newspaper in 2011 to make money.'"

According to the Los Angeles Times, "AEG was paying for everything in his [Jackson's] life - from his rented Holmby Hills mansion to the personal chef who prepared him organic juices - as well as the huge expense of mounting a high-tech show that included multiple sets, Jackson catapulting over the crowd and 3-D elements. If he failed to perform, Jackson would have to reimburse AEG more than $30 million, according to the defense."

Philip Anschutz is a devoted Christian. Over the years, he has supported a number of causes, candidates and institutions embraced by the religious right, including anti-gay initiatives and the Intelligent Design espousing Discovery Institute in Seattle, Washington. He also owns The Examiner chain of conservative newspapers, and The Weekly Standard - an influential conservative magazine - that he bought last year from Rupert Murdoch's News Corporation.

Given his business dealings in Los Angeles, his standing in the Denver community, his hammerlock on key aspects of the entertainment industry, and his status as one of the richest men in America, Anschutz is basically untouchable. But the question remains: In the name of profit, did AEG push an unprepared, out-of-shape, drug-taking Jackson to the brink?
