Die Jacksons haben die bewusste Entscheidung getroffen vom bankrotten Murray keinen Schadenseratz zu verlangen und ihm damit alle Optionen zu geben, nach seiner Haftstrafe mit Publikationen und IVs über MJ groß abzukassieren.

Sollte AEG den Jacksons kurz vor knapp ein Settlement anbieten, gehe ich jede Wette ein, dass sie es annehmen werden, ehe sie am Ende ohne jeden Cent dastehen.

Die Jacksons haben von sich aus nun die Vernehmung mit Murray gecancelt. Der Grund dafür? Die Aussage, dass Murray beabsichtigt nicht auszusagen kann es ja wohl nicht sein. Dies ließ Murrays Anwältin ja schon vorher verkünden. Von daher finde ich die Aussagen diesbezüglich von AEGs Anwältin recht sinnig.

Los Angeles (CNN) -- Dr. Conrad Murray, who was Michael Jackson's personal physician, is refusing to testify in the wrongful death lawsuit that the singer's mother filed against concert promoter AEG Live.

If called, he will plead the fifth so as not to incriminate himself, the doctor said in a statement sent to the Jackson family.
Murray has never been questioned under oath about Jackson's death, which occurred on his watch.

He did not testify at his trial, where he was found guilty of causing Jackson's death on June 25, 2009, by administering a deadly overdose of sedatives and the surgical anesthetic propofol in what he told police was an attempt to cure the singer's insomnia.
He is serving a four-year sentence but could be out in two.

On Monday, he was supposed to be deposed in the wrongful death suit.
But lawyers for Jackson's mother, Katherine, and her three children called off their jailhouse visit because Murray swore "he would not answer any questions at the deposition or the trial," Jackson lawyer Kevin Boyle told CNN. He said the Jackson case would not suffer without his testimony.

AEG's lawyer suggests the Jacksons canceled Murray's deposition because his testimony would "destroy" their case.
"They are not interested in the truth," said the lawyer, Marvin Putnam.

Asserting his 'Fifth Amendment privilege'
The cancellation came after Murray's attorney Valerie Wass sent the Jacksons a sworn statement signed by Murray making it clear he would not answer any questions while his involuntary manslaughter conviction in Michael Jackson's death is being appealed.
"Accordingly, if I am called or ordered to testify at deposition or trial in the Katherine Jackson vs AEG wrongful death case, I will be asserting my Fifth Amendment privilege against self-incrimination and refuse to answer any questions," Murray's declaration said.
Jury selection in the civil trial is set to begin April 2 in a Los Angeles County court.

Prince Jackson, the pop star's oldest son, is expected to testify about his father's last days.

Jacksons: Focus back on AEG
The Jackson lawsuit contends that AEG Live is responsible for Jackson's death because it hired and supervised Dr. Murray, who was administering the surgical anesthetic propofol to Jackson each night for a month to induce sleep as he prepared for a series of concerts organized by AEG Live.

A jury found Dr. Murray guilty of involuntary manslaughter after hearing testimony that he violated medical standards in his treatment of Jackson.

"Dr. Murray's choice to keep quiet puts the focus back on the company, AEG, that hired Dr. Murray and agreed to pay him over $1.5 million a year, and provide Murray with a large house and drivers and other perks, to make sure that the company's biggest asset, Michael Jackson, made it to the shows on time, no matter what," Boyle, the Jacksons' lawyer said.

A judge ruled last month that Jackson lawyers could question Murray at the Los Angeles County jail, where he is serving his prison sentence.

AEG: Testimony destroys Jacksons' claim
"The Jacksons told the world that they wanted Dr. Murray's deposition, and then when the Court gave it to them, they canceled it," Putnam, the AEG lawyer, told CNN on Sunday.

"They have had all of their claims dismissed except negligent hiring, and they don't want Dr. Murray to be deposed because he will tell them what he already told the police: that he worked for Michael Jackson; that Michael Jackson, not AEG, was his employer; and that Michael Jackson personally invited him to join the 'This is It' tour long before anyone at AEG had even heard of him. The Jacksons canceled the deposition because that testimony destroys the only claim they have left. They are not interested in the truth."

Back and forth
The Jacksons' lawyer argued, in response to Putnam's comment, that AEG was not interested in having Murray take the stand in the trial.

"AEG did not even try to get Dr. Murray to talk," Boyle said. "AEG is simply not telling the truth. AEG can't run from the fact that they hired The Man who is in jail for killing the greatest entertainer the world has ever known."

Wass, who unsuccessfully objected to the deposition, said she advised Murray to invoke his Fifth Amendment right to not answer questions because of his appeal. The appeal brief is expected to be filed next week.

Jacksons plan to use e-mails
Jackson died two weeks before his "This is it" comeback concerts, organized by AEG Live, were to have debuted in London in the summer of 2009.

E-mails the Jackson's plan to use in their case suggested that the promoter was worried about Jackson's missed rehearsals and they sought Murray's help in getting him ready.

Prince, Paris and Blanket Jackson and their grandmother contend that AEG Live's pressure on Murray to have Jackson ready for daily rehearsals despite his fragile health led to his death from the propofol overdose.

A cornerstone of the Jacksons' case is an e-mail AEG Live co-CEO Paul Gongaware wrote 11 days before Jackson's death.
The e-mail to show director Kenny Ortega addressed concerns that Murray had kept Jackson from a rehearsal the day before: "We want to remind (Murray) that it is AEG, not MJ, who is paying his salary. We want to remind him what is expected of him."

Jackson lawyers, calling it a "smoking gun," argue the e-mail is evidence that AEG Live used Murray's fear of losing his $150,000-a-month job as Jackson's personal physician to pressure him to have Jackson ready for rehearsals despite his fragile health.

Billions at stake
The lawsuit seeks a judgment against AEG Live equal to the money Jackson would have earned over the course of his remaining lifetime if he had not died.

If AEG Live is found liable, it could cost the company several billion dollars, according to estimates of Jackson's income potential.
AEG Live is a subsidiary of AEG, a global entertainment company that was recently for sale with an $8 billion asking price.

The company announced last week it was no longer for sale.

Michael Jackson‘s daughter, Paris, is being deposed Thursday afternoon in Los Angeles in connection with a wrongful death lawsuit her grandmother, Katherine Jackson, filed against concert promoter, AEG, RadarOnline.com is exclusively reporting.

Katherine contends that AEG was responsible for her son’s death because they were responsible for hiring Dr. Conrad Murray to be his physician.

“The deposition will take place in a private interview room that is big enough to accomodate lawyers for Katherine, and AEG, beginning at 1:30,” a source tells RadarOnline.com exclusively.

“The deposition could go all day. Even though Paris isn’t expected to testify at the trial, AEG wanted to take her deposition because she is a co-Plaintiff in the case.

Prince Jackson, Michael’s oldest child, “was also deposed last week, and it didn’t go well for him. In fact the proceedings grew so intense for Prince, that a break was called, and it had to resume the next day,” the insider tells us.

As RadarOnline.com previously reported, Prince plans on testifying at the trial, which is scheduled to begin in April.

Katherine suffered a huge legal setback recently when a California court dismissed all but one of her claims against AEG and its president, Tim Leiweke.

The defendants have filed legal documents with the Court of Appeal in California to dismiss that one claim, on the question of whether AEG Live negligently hired Murray, Jackson’s long time personal physician. Additionally, all but one of her claims against the remaining defendants were dismissed and the California Court of Appeals ordered Michael’s medical records unsealed.

Murray was convicted in 2011 for the involuntary manslaughter death of Michael after administering a fatal dose of propofol to help the pop singer sleep.

Murray hadn’t formally signed his employment contract with AEG at the time of Michael’s death, and say they aren’t responsible for his tragic death.

Kann sich ja jeder mal ein Bild zu machen aus den Aussagen. Prince wurde vernommen unter Ausschluss der Öffentlichkeit an einem privaten Ort unter Beisein von Kathrine, TJ u. deren Anwälten, an einem Nicht-Schultag. Für Paris stellten die Jacksons nun den Antrag, dass sie im Gericht vernommen werden solle, an einem Schultag. Begründung wäre das Prince unangemessen behandelt wurde bei der Vernehmung, was den Jacksons offensichtlich 2 Wochen später erstmals äußerten.
Die Folge Paris Termin und Ort der Befragung war nun der Presse bekannt und Paris konnte von Paparazi zu Gericht begleitet werden und als mediales Ereignis verfolgt werden. Die Jacksons haben im Übirgen nie eine Protectiv-Antrag für Paris und Prince gestellt, diesen haben sie nur für Blanket gestellt.

Der Antrag von AEG vor dem Berufungsgericht für Verwerfung des verbliebenen Klagepunktes wurde übrigens abgelehnt.

Den zweiten Teil des Satzes lass ich mal weg, weil er anzweifelt dass es so gewesen ist und impliziert, dass die Jacksons mal wieder ein Fass aufmachen. In diesem Fall würde ich mir wünschen, dass es nur ein Fass ist und nicht stimmt, dass Prince so behandelt wurde.

Und nun geht's nochmal vor Gericht...

AP LOS ANGELES — A Los Angeles judge set the stage Thursday for trial of a civil suit by Michael Jackson’s mother against concert giant AEG Live.

Katherine Jackson claims the company negligently hired the doctor later convicted of involuntary manslaughter in the singer’s death and failed to oversee him. She and the singer’s two eldest children are expected to testify about the singer’s last days.

.Legal rulings by Superior Court Judge Yvette Palazuelos anticipated a three-month trial that will revisit events preceding the singer’s death from an anesthetic overdose in 2009.

Dr. Conrad Murray, who was convicted of manslaughter for administering the drug propofol, is not named in the lawsuit. But the judge agreed to allow him to be brought to court from jail to testify outside the jury’s presence. He has said he would invoke his Fifth Amendment right not to testify. But lawyers said he could possibly talk about non-criminal issues.

The judge said jury selection would begin April 2 and attorneys estimated the search for a panel could be long and difficult because of the notoriety of the parties and the estimated length of the trial.

In diesem Forum treten die Mods eher selten in Erscheinung, weil es unnötig ist und wir uns als User verständigen können. Ausnahmen gibt es natürlich, aber die sind für die MODs auch nicht angenehm.
Selbstverantwortung, Selbstregulation, Selbstreflektion sind keine schlechten Eigenschaften für einen virtuellen Austausch.

Gut, dass sie die Fragen ausschließen, wo man den Zusammenhang wirklich nicht erkennen kann.

Interessant auch was die beiden Großen zu Murray denken (sollen). Finde ich schon sehr erstaunlich. Der Mann hat ihren Vater das Leben gekostet mit seinem Verhalten. Er muss also durchaus einen Menge Sympathiebonus haben und sich wie ein Freund des Vaters gegeben haben, oder?
Oder geht es darum die Schuld weg von Murray auf AEG zu lenken?
Ist das weil die Kids Murray nicht die Schuld geben und zwar weil Prince weiß wie sein Vater über AEG redete - oder ist es ein Schachzug im Sinne der ganz großen Offensive (40 Milliarden). Für die Summe würden viele Menschen ALLES tun.

AEG states they tried to avoid to depose Prince &Paris but they are
important witnesses as they stated they interacted with Murray before
AEG came into the picture.

AEG also states that Michael's kids are active in entertainment
industry, have twitter accounts, make appearances and give interviews.

After trying to set dates for sometime, they agree to do depositions on Saturday to fit with school schedules and avoid media.

Prince goes to his deposition on March 2 with TJ, Katherine,3 lawyers & security. AEG's lawyers arrange for them to enter unseen to offices. AEG states they provided lunches to everyone and treated Prince with care & courtesy. They say Katherine thanked them for accommodations.

After 2 hours of deposition, when they start Prince asking about Murray, KJ's lawyers end deposition saying Prince was tired.
AEG states they had problems with setting time for the continuance of
Prince's deposition and Paris's deposition kept being cancelled.

AEG states then they later heard complaint about how they treated
Prince , they deny such claims and say they showed care & courtesy.

It looks like after a lot of back and forth Prince's deposition was continued this Tuesday and Paris's is set for today.

KJ's lawyers wanted to move Paris's deposition to the court house rather than AEG lawyers offices. AEG doesn't understand this.AEG states media reports this case extensively and they would report today's status hearing. Hence media would see Paris coming to court.
AEG states they did everything to ensure privacy for Prince but KJ's
lawyers move to depose Paris at the court would expose her to media

AEG also gives the judge copy of Prince's deposition (sealed from
public) to see that there were no improper behavior towards Prince.
